Dear Client, To prove that Restitution of Conjugal Rights (RCR) can affect the validity and subsistence of a marriage, one needs to establish that the RCR decree, if enforced, could lead to circumstances where the marriage is no longer viable or could be declared void or voidable under the law. This can be achieved by demonstrating that forcing a spouse to cohabit against their will undermines the fundamental principles of marriage, such as mutual consent and freedom of choice, and can ultimately lead to the breakdown of the relationship.

Well, if the Wife deserts you without any substantive reasons legally justifiable and legally valid, then by filing a RCR Petition, you can expose her before the concerned Family Court, as she has to put reasons before the Court on Affidavit, that, 'Why she has deserted you?' If she will not be able to put forth the concrete reasons, Court will order her to restore Marital life with you including Cohabitation and Conjugation, however, implementing such favorable order will be in her hands, if she won't implement the order, you will get Divorce!

In India, Restitution of Conjugal Rights (RCR) is a legal remedy designed to compel a spouse to return to cohabitation, while in the UK, divorce is the legal means to dissolve a marriage. RCR orders do not dissolve the marriage, unlike divorce in the UK, where the marriage is formally terminated.
