In my contested divorce Case 2 years have gone and opposite party didn't filed ws so far...as per order 8 rule 1 court punished them with heavy cost providing no ws order...
Kindly guide me on ...
1. When I will get divorce
2. What next step I should take in court..
This is my response to you:
1. Ask the court to pass another order if they do not produce the WS;
2. Tell the court to pass order that the other side has waived off the right to tender a WS and should not be given more chances;
3. Then ask the court to pronounce the ex-parte decree if they refuse to attend court;
4. Consult a local lawyer and do the same.

Dear Querist, as per your query the other side has failed to file the WS and the period for the same is much then the provisions of the CPC. Also the Court has punished with heavy cost. Therefore here in this case you can go for ex-parte for the same

If the opposite party fails to file Written Statement you can ask the court to proceed ex-parte and you can also ask for maintenance and you will surely obtain decree if husband fails to contest the case.
