Improper investigation by IO 498a
25-Sep-2024 (In Divorce Law)
Fake 498a has been filed against me and family and also 354 against my 76-year-old father. during investigation I had handed some documents to the IO which he didn't add in the chargesheet and also denied getting anything, I don't have proof of handling the docs to him. I'm sure he was greased by wife side. FIR quashing might waste time and money, can I or father ask for reinvestigation of the matter and request a different IO this time? Any provision for this? Trial hasn't begun yet.
Dear Sir,
If the Chargesheet has been presented before the Ld. Trial Court then you can file a discharge application before the Trial Court and you adduce you additional documents therein. The Court will observe the evidence put forth and check whether prima facie evidence calls for framing of charge or not. If it is observed that no case is made out, then the Court will discharge you and your family from the accusations levied.
