your lawyer must appear for you before court if you have appointed him with fees and if he has not appeared there must be some reason which you need to ask him or her moreover if one date he did not appear next date must have been issued

if you have given regular fees to your advocate then your advocate is under a legal compulsion to attend to your case with diligence. from my own experience I can tell you that advocates only looses interest in a case when the client stops showing interest in paying the fees else any advocate would do everything within his capabilities to ensure that each date is made worthy for their clients. now coming to your first query if you remain unrepresented then your claim for maintenance would fail or would get postponed depending on the stage of non appearance. if your advocate is not keeping you updated then update yourself with some other advocate. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, High Court Calcutta.
