If file 498 after divorce from husband, then it will help him?

30-Jan-2023 (In Divorce Law)
My sis is facing a lot of problem in her second marriage due to dowry/salary demand from her MIL and Husband. In collusion with each other, they provided House Eviction Notice, Case in Senior Citizen act just to throw my sis out of her Matrimonial House. She has all proof of this Collusion. She went in Women Cell and then Domestic Violence to get stay order and received same. Withdraw women cell case in hope that husband will understand but he filed Divorce case with provable false charges in his petition. nCan my sis file 498 case against him (have proof). Will it help him to get Divorce? She tried all possible way to save her marriage but husband is too egotistic. She does not was not give divorce.

If the behaviour of your husband is intolerable towards you then rather then dragging your relationship you can always register a FIR against your husband and in-laws and also file a complaint under DV act and claim your monthly maintenance. For more legal assistance I am just a call away.

Dear Client A divorce case is a separate case all together. Filing of a 498a will not have any bearing on the merits of the divorce case. In case of cruelty will have its separate proceedings. in case the husband is also willing to be separated. The best was out would be filing of a divorce petition by way of mutual consent, the same will save you lot of time. Feel free to get in touch to discuss further.
