I want to file divorce before it's too late

I have already asked my husband to divorce me .neither he is willing to divorce me nor he is staying with me .I am mentally and physically and mentally tortured by him and my in laws.he wants me to leave his house and go to my parents .he will no help me financially.and want to impose false claims on me if I go home.

If your husband is refusing to give divorce and is also mentally or physically harassing you, the law provides several remedies to protect you. You can file a contested divorce on the ground of cruelty before the Family Court even if your husband does not agree to divorce. His consent is not required in such cases. Further, if you are being harassed by your husband or in-laws or being forced to leave the matrimonial home without financial support, you may also take legal action under the Protection of Women from Domestic Violence Act, where you can claim protection, residence rights and maintenance. You can also seek maintenance if he is not supporting you financially. If you fear false allegations, try to keep records such as messages, recordings or other evidence. It is advisable to consult a family law advocate and take appropriate legal steps to protect your rights.

As you have told that your husband wants to divorce you and his family members are also harassing you. Your family members are also not supporting you . It is financial week thereIf either of the husband and wife files a divorce case, then it is important that the grounds given in your petition are absolutely genuine and you can prove them in the courtIf you are financially weak then till then you can file a maintenance case against your husband and get the expenses from him

you should file a petition of mutual divorce you are mentally and physically tortured you cab file a petition of cruelty he wants me to leave the house you can file a maintenance petition under section 125 crpc you can go in for mediation

aap chahe to divorce case file kar sakti hai,aur phle divorce nhi file Krna chahti hai to aap maintance, aur in-laws k liye dv act case kr sakti hai ,aur police case bhi kr skti hai, in sare cases k baad vo ya to sahi behave karenge ya phir khud hi divorce petition file kr skte h jisse aap apne condition par divorce lekr alg ho sakti h,
