Mounika, since your husband left you in October 2024 and you have been managing your own expenses as a staff nurse while he abandoned his job and stayed away for prayer meetings, you can file for divorce on grounds of desertion under Section 13(1)(ib) of the Hindu Marriage Act, 1955, as the Supreme Court has held that desertion means not just physical separation but a complete withdrawal from the state of matrimony without reasonable cause. You can also claim maintenance under Section 24 of the Act during the divorce proceedings and permanent alimony under Section 25 even after the divorce decree is passed. File your divorce petition immediately in the family court having jurisdiction where you last lived together or where your husband currently resides.

You can file for divorce on grounds of desertion and mental cruelty. You are also entitled to claim maintenance. Keep records of separation and expenses. File a petition in family court through a local advocate.
