I want to change my lawyer. Do I need to pay money If I changed him

We hired lawyer filed sec13 1ia. He also filed counter for sec9 which was filed by my wife. For both filings we paid money to my lawyer. From last 3 years case was dragging. Current status for both cases are pending one time my lawyer cross examined her. I am not satisfied with my lawyer. If I continue my cases with another lawyer do I need to pay money to my lawyer? How to get papers from my lawyer?

You need not take anything from your previous counsel as everything is available in the judicial file that can be fetched through applying the certified copy of the same. For more legal assistance I am just a call away.

Sir you don’t have to pay to your old lawyer once you appoint a new lawyer it’s just if there is anything pending that only you have to pay and request the lawyer to return your file. and if he does not that there is another remedy by that you can get your paper despite that you dont have given any original documents with him.

Hello, You should settle any outstanding dues with your current lawyer before engaging a new one. If your lawyer refuses to hand over the case file, you can obtain certified copies from the court, and your new lawyer can assist you with this process. Additionally, if you feel your case is being unnecessarily delayed, consider filing an application under Section 151 of the CPC, requesting the court to expedite proceedings by highlighting the undue delay of three years. If you are dissatisfied with your current lawyer, you can switch to a new one by clearing any pending fees for the work already done, as per your fee agreement or mutual understanding. Request your case papers directly from the current lawyer. Once you have the papers, your new lawyer can file a Vakalatnama to take over the case, and you must inform the court about the change in representation.

in case you have fee dues left .. u pay him and get your files ... if all dues are clear then you can get the file ... still in case there is difficulty in getting the files .. u can hire a new lawyer who will help u get you case record from the concerned court where your case is pending
