I want divorce from my wife as I love someone else.

We have married since 16 years,we have 2 children.from last several years our bonding and mutual understanding is going through rough phases and we fight often. Since last almost 2 years I am living saparate and I am in love with someone else.so how can I get divorce as my wife denied to give divorce??

You can file a petition for divorce in the court on the ground of cruelty and harassment by your wife. However you cannot mention that you are having an extra marital affair as the same good go against you. If your wife is also ready for divorce you both can file a mutual consent divorce petition and get separated.

Well, you need to file a case of Unilateral Divorce under the concerned provisions of law. Unilateral Divorce can take years down the line, you need to prove either the marriage has become dead between you or other grounds to seek Unilateral Divorce mentioned under the Hindu Marriage Act, 1955
