I want divorce from my husband without any alumini

20-Jun-2026 (In Divorce Law)
Hi, I am Neha Chaudhary. I got married five years ago, but due to many ongoing issues and differences, I am not happy in my marriage. I would like to separate from my husband and seek a divorce in a peaceful and mutual manner. I am not interested in claiming any alimony or financial support. I would appreciate guidance on how to proceed smoothly and legally.

Hello Neha, I understand your situation. If both you and your husband mutually agree to end the marriage, you can file a Mutual Consent Divorce petition under Section 13B of the Hindu Marriage Act. Since you do not wish to claim any alimony or financial support, the terms can be clearly recorded in the settlement agreement. To guide you properly, please share your city, the date of marriage, whether you have any children and whether your husband is also willing to proceed with a mutual divorce. I can assist you with the complete legal process and documentation.

Since both parties agree and you are not seeking alimony, a Mutual Consent Divorce can be filed for a peaceful separation. Consult a family lawyer to complete the process smoothly and protect your rights.

hello Neha. if you wish to proceed for mutual divorce without claiming any alimony or financial support, you need to firstly send a legal notice for mutual divorce or else if the husband is ready for mutual divorce simply you both need to file a joint petition in family court by filing vakaltnama of advocate. if he's not ready, sending legal notice would be fruitful since you mention your intention of seeking mutual Divorce without alimony.

You may proceed through Mutual Consent Divorce if both parties agree to separate amicably. It involves jointly filing a petition, settling terms in writing, and completing court formalities. A lawyer can help ensure a smooth legal process.

First please let me know if you got married under HMA or not according to Hindu ritual rights and ceremonies and if your husband also wants to get separated. If the divorce is mutual then you can proceed to file it in 13(B) and if not then you can go with section 13. If you have any further questions, please feel free to contact me.
