You will have file for either a contested or mutual divorce At the appropriate court. And a custody of the child should also be filed for since she six years of age majorly the custody goes to the mother and however I believe that the child is already with you so you can file for decree of custody in your favour from the appropriate court for further relief note can please get in touch with my office
