19-Feb-2025 (In Divorce Law)
My marriage took place on November 22, 2024, and on January 1, 2025, I caught my husband (28 years old) cheating on me with a 43-year-old woman. He was seen going to her apartment with a condom. However, the woman claims that she was unaware of the situation regarding the condom, and my husband denies having any knowledge of my intentions. I have already filed a complaint with the Mahila Ayog Kendra, as I suspect my husband is trying to protect her. Can you guide me on how to proceed and which l

You can file for divorce under cruelty or adultery, depending on the evidence. If needed, file for maintenance. Evidence like messages, photos, or witnesses will help. You may consult us for further action if needed

Collect proof of your husband’s infidelity, such as messages, call records, or witness statements. If you wish to separate, you can file for divorce under adultery or mental cruelty in court. Though adultery is not a criminal offense in India, if your husband is harassing or threatening you, you can file a complaint under Section 498A (cruelty by husband). Under Section 125 CrPC or Hindu Marriage Act, you can claim financial support. If you fear threats or coercion, you can apply for protection under the Domestic Violence Act.
