I have put contested divorce on my wife what alimony I have to pay if I win the case I have shown 15000 as income my wife is staying at matrimonial home husband and his parents are staying at rented home because of wifes harassment maintenance is decided 12000 now out of the court settlement the party is demanding 40-50 lakhs I don't have much money should I wait for judgement or settle outside the court
Irrespective of whatever you say is your income, in evidence you will have to submit your income and liabilities statement which will tell all the story. If the demand made by your wife is anything which seems reasonable to you then you can settle but not outside the Court. You must settle, if need arises and as you deem fit, should be before the Court, else it shall be a blackmail otherwise. Feel free to contact me for seeking any legal advice as regards the same.
Alimony or settlement amount is not fixed and depends on several factors, including the husband's income, wife's earning capacity, standard of living during marriage, and reasonable needs. Since you have already disclosed your income as ₹15,000/month and are paying ₹12,000/month as maintenance, the court is unlikely to award a lump sum settlement of ₹40-50 lakhs unless you have hidden assets or income.
If you cannot afford the demanded amount, you should not feel pressured into settling. You can present your financial documents and let the court decide a fair and just amount based on merits. Settling outside court is only advisable if the amount is reasonable and within your means. Otherwise, contesting the claim and seeking a court judgment would be more practical and transparent.
Dear client based on your query, in such cases, the decision to settle or await judgment often hinges on financial capacity, legal merits, and the likelihood of a court awarding a proportionate amount based on documented income and circumstances, also for relevance we can help you regarding the process and in legal ways for which you can connect with us.
Dear Client,
Since you've already filed a contested divorce and maintenance is fixed at ₹12,000 per month based on your shown income of ₹15,000, any lump sum demand of ₹40–50 lakhs appears disproportionate and may not be accepted by the court, especially if you can prove limited financial capacity.
If your wife is living in the matrimonial home and you and your parents are forced to live on rent due to her conduct, these facts can help your case both for divorce and to limit or reduce future alimony.
Out-of-court settlements are quicker but only advisable if the amount is reasonable and affordable. If the demand is beyond your means and without merit, it’s better to continue with the legal process and let the court decide based on evidence and your actual capacity.
However, if the settlement demand reduces and gives you a clean break with mutual consent, it could save time, stress, and future litigation.
We can negotiate or put a counter-offer if you’re open to settlement. Let’s assess all financials and merits before taking the final call.
