The respondent has not yet filed their Written Statement, and The court has not passed an adverse order like: “WS closed” “Proceed ex-parte” “No further chance to file WS” So legally, the respondent still has an opportunity to participate in the case. Possible situations Time granted but not expired The court may have given time to the respondent to file WS, and that time is still running. Delay but court is lenient Even if there is delay, family courts often give multiple chances unless there is intentional non-appearance. No penal order yet Since no WS-closure or ex-parte order is passed, the case is still contested, not one-sided.

As the No Written Statement Order has been passed by the court. The matter shall move ahead without the Written Statement of the Respondent. Or else they can challenge the said Order. Kindly connect to discuss in length.

you need to start your evidence as soon as possible otherwise the respondent will file for the application to set aside no WS order, and let him file a written statement this kind of application easily gets allowed subject to some payment of 1000-2000 rupees. hurry and ask your lawyer to take some steps.
