You have been posting the same question many times ….in your case you have to hire an advocate and if you have already hired an advocate then please follow him because posting questions here will make you more confuse …therefore you must file application for execution if court has already passed maintenance…thanks

In divorce it becomes difficult to fetch out the maintenance or the alimony. You need to file a separate case like Domestic Violence or an application under section 125 CrPC for the grant of your monthly maintenance. You should attach your medical data also along with your file. For more legal assistance I am just a call away.

Section – 13(1)(ia) of Hindu Marriage Act defines cruelty as wilful and unjustifiable conduct of such character as to cause danger to life, limb or health, bodily or mental, or as to give rise to a reasonable apprehension of such a danger. The situations that you have experienced have left you unwell with many diseases. Such a person cannot be expected to work and maintain themselves. Therefore you can file for divorce on grounds of cruelty and dowry harrasment.

You should file a maintenance petition under section 125 of the criminal procedure code. Besides this you can also file domestic violence case against your husband and in laws. Ultimately, if no conciliation arrived before CAW cell then a FIR gets registered. finally after settlement or litigation as the case may be divorce may be obtained.
