If both husband and wife have mutually agreed to end the marriage, the simplest option is to file a Mutual Consent Divorce Petition under Section 13B of the Hindu Marriage Act. A divorce cannot be completed merely through a private agreement or notarized document outside the court; a court decree is required to legally dissolve the marriage. Before filing, both parties can execute a written settlement covering alimony, maintenance, child custody/visitation (if any), return of articles, and withdrawal of pending cases. Once the settlement is finalized, a joint petition can be filed before the Family Court. The time required depends on the facts and the court. In many cases, if both parties cooperate and there is no dispute regarding maintenance or custody, the process can be completed within a few months. If mutual consent is not possible, then a contested divorce petition may have to be filed, which generally takes longer. It is advisable to first prepare a comprehensive settlement agreement and then proceed with the mutual consent divorce petition to avoid future disputes.

Hi, You can not file for mutual consent divorce if the time of separation is not met. Instead you will need to go for annulment of marriage for which you can approach the family court of your jurisdiction. If your wife is ready to consent for the same, the process can be shortened. I can guide you with the process for the same.

U can file for divorce by mutual consent if ur wife is also ready to file and give divorce. Otherwise u can file for contested divorce on grounds of cruelty as she is involved with other person with all the evidence which u have including chats , recordings etc .In mutual divorce both the parties can have one counsel to represent them and cooling period also gets waived off if both are not willing to live together .

process can be done inside the court but it will be completed without any issues because there will be mutual concent of both the parties . so it can be done as soon as the court will be issued a decree. and it will not be time consuming as compare to other divorce cases that will be running in the court itself
