I got divorce in my favour 3 years ago under section 27. My ex wife did not challenge the order then. But now as she's almost going to lose the maintenance case as well because she was of the divorce order and she's also well educated and earning lady. So, I suppose that's why she has file an Mc case under order 9 rule 13. I have the tracking report that the summons were duly served to her in the divorce case. Still, can the court set the divorce decree aside?

The court only sets aside the ex-decree when the defendant presents a satisfactory reason in court or the summons is not served well. Since in your case the summons were duly received by her then she had to take out a strong excuse to defend. It's just a matter of arguments from your side. hello client as a matter of facts which you have quoted is really matter of over looking the fact of the case. so in this matter i nees to know the full case details then only i can suggest you the best as well as your ex wife will also be imposed with heavy cost as well
