I am facing a complicated Divorce query. Please help me out.

My Friend wants divorce from his wife from the day he got married but they are not ready to give.he asked them for 3 times but they was pressuring him like will give dowry complaint on you like that, seeing all these he committed suicide and he is out of danger he is alive now. He still wants divorce from her. will he get divorce from her?? Still is there any changes that girl can give complain against my friend after all this suicide attempts?? Please reply

Yes there is a solution for this
If we have to take a divorce from wife then we have to file a divorce petition
And in this divorce petition there is no need of consent of wife but the court can decide the matter without the consent of wife
We have to file divorce petition on the ground of cruelty done by wife and harassment done by wife as well as she has done mental and physical torture.
Another thing is that wife can lodge a complaint to the concerned police station about our suicide attempts so before the wife reach to the police station we have to take an action against her

As per your friends quarry, your friend can get divorce. On ground of cruelty. He can file divorce on ground of cruelty by which he has attempted suicide. Is it any complaint filed by your friend or having any medical report of committed of suicide?
Your friend can move divorce petition.
Also he can file pokice compliant for harassment by his wife.

If your friend willing to give divorce then he need to be sure that why he wants divorce from her and what are ground that makes him to take this step and accordingly he can file divorce proceeding before court of law.

First of all there is no need to get panic about the situation.
Ask your friend to file for Divorce in the Family Court at the earliest. Such Petition can be filed only after 1 year of marriage. Even if his wife files any Complaints on the ground of dowry that will be proved as after thought and will not have any effect in those matters. If your friend is thinking that if any such complaint is filed by his wife on the ground of dowry whether he will get arrested. Then the answer is NO. The Supreme Court in their latest Judgment has given the directions that if complaint is made by the wife under Section 498-A of IPC the husband should not be arrested.
Therefore there are no reasons your friend should worried of. Please advise your friend to file for Divorce Petition at the earliest before his wife makes any complaints.
Further even if any such attempt of suicide was made by your friend, his wife cant file any complaints to that effect. So please ask your friend to be calm and take appropriate steps.

As per your query you should have a firm reason to take consent for divorce from his wife. If wife is not ready you can file a divorce petition under the provisions of the Divorce Act or Hindu Marriage Act.
