Husband threatening to file for divorce on medical grounds

24-Oct-2023 (In Divorce Law)
My husband is stating that he will give me a divorce within 3 months of marriage because my parents haven't told him about a issue of mine initially. I don't want to give divorce. Will he be able to file it under any pretext of my medical grounds? What will be the procedure?

Hi,
You have not stated as to what is the nature of the medical problem whether it is curable or not , secondary thing is that does your husband having any medical certificates or what are the proof he has that you are medically ill etc. Try to get medical treatment firstly and options are open for him to file in one pretext or the other but ultimately it has to be proved what he alleges. Call us with the details to assist you further.

Madam,

Your husband can file a petition for annulment of marriage before 1 year of marriage on the ground that the consent to the marriage was based on fraud or force and he can file the petition along with proofs showing your medical issues before the marriage. However, it is to be seen if the court annuls the marriage as annulling marriage on medical grounds is very tough. This I am saying as you did not share the nature of the disease or ailment you may have. Your medical grounds need to be known fully in order to render proper advice. Contact a family court lawyer and take his/her advice.
