Husband not accepting baby girl and forcing me to live in a village
24-Feb-2023 (In Divorce Law)
Married for 3 years, husband business in delhi. His dad's business in a village in Rajasthan. I was 3 months pregnant when I went to visit my parents in Coimbatore. After this my husband packed both our home and business & shifted back to his parents. I came to know this via housemaid. Now before engagement, I had clearly specified I cannot live in a village. When I told him I can't live there as his parents trouble me, he didn't listen and responded saying I will stay there only. I ceased all conversations with my husband. After 6 months, when I delivered, my father called him. He also called at naming ceremony but didn't turn up. Then I msged him as to when he is coming to see our baby girl,no response. Now divorce is a very easy way out for him which I don't want atleast 3 years. So what is the best solution for me? Also they are too quick witted to provide spouse support to me or child support. How do I get that?
If you want to drag the matter you file petiyion in your juraidiction court for restitition of conjugal rights or maintenence. In the maintenance petition if get the order of payment you could attach his property in case he fails to pay.
You can file a petition for restitution of conjugal rights (asking him to take you back). You can also file for maintenance for your child and yourself. If necessary you can also file a complaint under Domestic Violence Act. During these proceedings you can ask the Judge to post the Mediation and the Mediators will try to explain to your husband that he has to take you back and live in a City so that the future of the child will be better. You will have to meet me and discuss in person to get proper and detailed advice.
File a petition for restitution of conjugal right petition before the court. While pending the said proceedings you may file a maintenance case against your husband to maintain you and your child. It os bofunded duty upon your husband to maintain you and tour child. Once you resort all the action simultaneously your husband may change his mind.
