Admitting to living with another woman, without proof of a second legal marriage, does not amount to bigamy, though it may be grounds for cruelty or adultery under divorce proceedings. You can file charges for adultery and cruelty

No, the present circumstances shall not amount to the offence of bigamy. It is pertinent to note that if a legally wedded husband engages in a live-in relationship with another woman without entering into a lawful marriage, such conduct may constitute an act of adultery within the meaning of matrimonial laws, thereby furnishing sufficient grounds for the aggrieved spouse to seek dissolution of marriage. Under Section 13(1)(i) of the Hindu Marriage Act, 1955, voluntary sexual intercourse by either spouse with any person other than their spouse is a valid ground for divorce. However, it is further clarified that as per the judgment of the Hon’ble Supreme Court in Joseph Shine v. Union of India (2018), adultery is no longer a criminal offence under Section 497 of the Indian Penal Code, but continues to remain a civil wrong and a recognized ground for divorce or judicial separation in matrimonial proceedings.
