If your husband is involved in an extramarital affair and making false promises to another woman about sharing property, you can take legal steps to protect yourself and your child without filing for divorce. Under Section 18 of the Hindu Adoptions and Maintenance Act, you can claim maintenance and residence rights while staying married. You can also seek protection and a residence order under the Domestic Violence Act, 2005. If he tries to transfer joint or ancestral property illegally, you may file a civil suit for injunction to restrain him. Consult a family lawyer to secure your financial and legal rights.
