Q: Advice Needed: Settlement Deed for Partial Refund from Shine.com

I paid Shine.com ₹18,040 in total — an initial ₹3,200 for a premium account, then two additional payments after calls from a relationship manager. Though they informed me before each payment, the practice was misleading, pushing multiple payments despite my refusal of the third. Now they offer a partial refund of ₹9,556 but want me to sign a settlement deed first. Is this deed necessary? How should I respond? What are my rights?

Sir the act of the opposite party clearly amounts to deficiency in service you being a consumer has legal remedy to sue them before a consumer court of competent jurisdiction. You need not to settle for partial refund, they have to pay you the same amount plus interest on the amount, mental harassment charges and also litigation expenses. So it would be better for you to proceed before consumer court rather than settle for lesser. Madam if you don’t want to live with your husband you have two remedies as per law you can initiate Divorce proceedings as per section 13 of HMA and if you both can settle it would be better you proceed with Section 13 B I.e., Mutual Divorce it will take lesser time a process of hardly 6 months.

what actions should be taken if a husband having a extra marital affairs and making fake promises to other women regarding sharing inheritance/ property with her. How to prevent it without divorce so I could secure me and my child.

Ma’am if you are first legally married wife all rights of property and inheritance lies with you. Your children have all the rights in property which are inherited and ancestral. You can take criminal action against your husband qua extra marital affairs and fake promises.

First of all I want to tell you that you need not to come to Gurugram every time. We can get you permanent exemption from appearance before the court from the Hon’ble High Court then you can monitor your case through your lawyer.
