23-Oct-2023 (In Divorce Law)
Hi we are hindu, we have completed 9thmnths of marriage.my wife always was on call aroung 3to 4hrs. One i caught him.i warmed do not talk to that guy.but stll she countinue.she used to send her personal pics to that guy.now asked not to come to my home.we are living separate.now shez trying to enter my home forcefully.how ca i stop her to enter
Sir if you don't want your wife to come to your home you can file a divorce petition if you want to dissolve your marriage you can go to police station Station that she is trying to forcefully entering you house and creating nusence
If you sure about her calls and pics then keep in safe custody. You can approach a lawyer who can file a adultery case. You will get divorce. They may file 498A also then you can show these evidence to police to avoid from arrest. Before that you ensure that it should not be in doubts.
Hi
if you are suspecting adultery on part of your wife, you should file a divorce case on grounds of adultery.
please note that you should have solid evidence to file a case for divorce on grounds of adultery. so hopefully you have evidences pertaining to your wife sending her personal pictures to the guy.
Also you can file a case u/s497 of IPC against the guy so that law takes its course of action on the guy who is interfering in your marital affair.

Sir,
You cannot restrict your wife to cohabit with you. It is a wife's right to reside along with her husband in her matrimonial home. Discuss with elders and try to resolve the issues to live peacefully. However, despite your attempts to change your wife, if she doesn't change, wait for another 3 months ( you cannot file for divorce before 1 year of marriage) and file for mutual consent divorce if your wife agrees for the same or else file contested divorce petition under the ground of cruelty before the jurisdictional family court where the marriage was solemnized or where you both last resided together.
