How to raise a complain against the Lawyer

11-Oct-2024 (In Divorce Law)
I consulted a lawyer in Pune about my divorce case, and unfortunately, he misled both my brother and me. He demanded a total payment of 3 lacs, asking for 1 lac to be paid through internet banking and 2 lacs in cash. In a rush, we paid him 85,000. However, within an hour, we realized it was a mistake and suspected he was attempting to launder money. We immediately requested a refund, excluding his consulting charges, but he refused. Now, we're unsure how to approach him to get our money back.

Advocacy is a nobel profession and such unprofessional act are not exused in the eyes of law. You may file a case against that advocate in office of Bar Counsil of Maharashtra and Goa. If you have proofs of transfer of money then definitely you will get your money and also seek compensation for mental harassment and suspension of advocate's licence imposing heavy fine.

If he is not paying refund ask him for the video call. Secondly you need to check weather have you paid the amount to the lawyer only And also you have to collect the evidence how you realised that he was defrauding you. If you have the evidence and you are sure you have paid to the lawyer You can file a complaint and report this to BAR COUNCIL of INDIA Or else If he is not a lawyer you can file a police complaint application in the nearest police station

In your situation, it sounds like you’ve fallen victim to a potentially fraudulent lawyer, which is both stressful and frustrating. Here’s a step-by-step guide on how to approach this issue Collect all communications you had with the lawyer, including emails, text messages, bank statements, or records of cash withdrawals. Document the timeline of events, starting from your first consultation to the request for the refund. You can send a legal notice to the lawyer demanding a refund for the amount paid. A legal notice will serve as a formal request and will put pressure on him. It's best to hire another trustworthy lawyer to draft this notice, making sure to explain the suspicious nature of his request (i.e., payment in cash and refusal to refund). The Bar Council of India oversees lawyers and their conduct. You can file a formal complaint against this lawyer in the Bar Council of Maharashtra, which may lead to disciplinary action. Provide all the evidence of malpractice, including the fact that he requested cash and internet payments and refused a refund when confronted. If you suspect money laundering or fraud, consider filing a complaint with the police for financial fraud. Mention the suspicious payment methods (cash and internet banking) and his refusal to refund the money when requested. If the lawyer continues to refuse the refund, you may pursue legal action through a civil court by filing a case for the recovery of the amount paid. Your new lawyer can advise you on the best approach and help recover the funds based on breach of trust or fraud. Always work with reputed professionals who are transparent about their fees. Avoid cash payments for legal services, and request receipts for all payments made. By taking these steps, you can increase your chances of getting your money back and holding the lawyer accountable for any unethical practices.
