How to proceed if wife backs out after filing for mutual divorce

Me and my wife applied mutual divorce after cooling period over she is saying neither she live with me nor she will give the divorce in this how can I file a case against her and get justice for me ?

Hello,

Withdraw from the MCD proceedings and file for contested divorce under cruelty ground in the same family court. Your wife has to contest the proceedings and eventually you may get the divorce based upon your strong representation in the court.

if your wife is not coming forward for mutual divorce after completing of 6 months period, you can withdraw the mutual divorce petition and must file contesting divorce

It is clearly visible that both of you are not willing for divorce. There is some communication gap or ego. Kindly seek elder family members counselling . Or meet some one known to both of you and they should matured enough. You are not mentioned your ages. In case you need any help contact us.

Dear Client,
Whether you want to live with her or to live separately. If you want divorce you can apply unilaterally. But there must be grounds to grant order of divorce. What is the dissatisfaction that was caused by your wife. whether she caused any mental harassment to you or whether her behavior is not good or on any grounds. First you must say your dissatisfaction to her. You must put the matter before elders and well wishers. If there are any misunderstandings, you both will settle amicably. If the defect is incurable then you must apply for divorce. Take expert legal advise. Consult an expert advocate and put the matter before him. He will give proper advise and guide you properly.
