How to get maintenance from husband

I GOT MARRIED ON MAY 2008.MY HUSBAND IS AN IT EMPLOYEE EARNS UPTO 2 LAKHS PER MONTH.I HAVE A DAUGHTER 8 YRS OLD. MY HUSBAND FILED DIVORCEE CASE ON JUNE 2016. I LIKE TO RE UNION. BUT HE IS ADAMENT. I FILED MAINTANENCE CASE ON SEP 2016. STILL MY MC CASE IS ON ENQUIRY. HOW MUCH AMOUNT WILL I GET EVERY MONTH,WILL IT IS ACTIVE FROM SEP 2016.HOW FAST CAN I GET IT. PLS HELP.THANK YOU SIR.

Dear Madam, I Have understood the case, The following details are required, his monthly take home and pay slip and any others loans if he already paying, based on that we have to work out and request monthly maintenance.

You have already filed for maintenance and you already have an Advocate. Surely he must be giving you proper advice. If you are not happy with his services then you may have to change your Advocate. You will have to follow up the case regularly by attending all the hearings.

It seems like your husband is delaying the matter by not coming up for enquiry.

If you wish, you can also file a petition before the high court for speedy disposal of the maintenance petition filed by you.

If he is able bodied person, he is supposed to provide maintenance to you and your child. You can file case under Sec -125 of CrPC and under Domestic Violence Act. You will definitely be provided by under the order of Court.

Firstly don't worry and you can avail maintenance under section 125 of cr.p.c for yourself and your son as well as it is statutory right so without further delay file the petition for maintenance along with that file an application for interim maintenance.
