How to get divorce from abusive and vengeful wife?

I need divorce from my wife, we are still staying together, but day by the domestic fights are growing up. i have to loose my self respect almost daily basis due to abusive language used for me and about my family, we live alone here in delhi and family is on hometown, still she abuses to them, she had once filed 498A also 3 years back but that was settled out of court and she came back after that and since than she behaves more rudely showing fear of dowry act again, due to women biased laws, i donot know how to deal, also have one son 6 year and working in MNC, she is housewife. My mother is suffering illness and i have to compromise due to bad circumstance, any helpful advice to deal them with law will be good. she says if required will go to police and court and will seek monthly wages.

Cruelty is considered as a ground for divorce in various laws. Often wife and their relatives take advantage of this ground in order to use it as a powerful weapon to threaten husband and their relatives. Some provisions under different laws are:
Section 13 of The Hindu Marriage Act, 1955: Under section 13 of The Hindu marriage act, cruelty is a ground for divorce.
Section 27 of The Special Marriage Act, 1954, provides for 12 grounds for divorce. One of them is cruelty.
Section 2 of The Dissolution of Muslim Marriages Act, 1939 also provides for dissolution of the marriage on the ground of cruelty.
Section 32 of The Parsi Marriage and Divorce Act, 1936, provides for 11 grounds for divorce. One of them is cruelty.
So, you can file for divorce on this ground itself. It is the duty of the court to decide the case based on facts and circumstances.

If you have made up your mind and your differences are growing day by day you can seek divorce on the grounds of cruelty that you have been facing??Just because of fear that what would be the after consequences of the act is not going to help you out somehow somewhere a initiative is required .Please contact for further details thanks.
