How to get divorce easily without mutual consent after 1 year marriage

27-May-2023 (In Divorce Law)
My wife is arrogant, selfish and I see she acts sometimes as if she loves me and my family members, she doesn't listen or obey to me and follows on her own way, she only listens to what her mother side family insists and ignores my family culture and she doesn't come/try to fit in our environment. There are no grounds of cruelty shown on her from my side like dowry, mental torture. Instead we respect her and help her a lot on daily basis (professional-work wise, make sure she maintains good health, environment, etc.) But she doesn't like to live with us and prefers to travel a lot to her mother's home and participates in all their cultural activities which we doesn't like her roaming this lot and there was dispute between their family and ours on this regard, their family is insisting that her daughter has to be with them on all occasions. It's been 5 months she left home after dispute and still didn't come. It's been mental torture to me and my family members since marriage every day.

Dear queriest as per your query you have mentioned that your wife is showing her tantrums, and therefore is unable to you to continue, and because dispute in your families she has not turned down from past 5 months, in such case if you want her to come back you file RESTITUTION OF CONJUGAL RIGHTS Under section 9 of Hindu marriage act.

the Hindu Marriage Act, 1955 mandates that in case of divorce by mutual consent, there has to be a composite period of 18 months of separation — one year provided in Section 13B (1) and six months in Section 13B (2).

Well, you can file for Restitution of Conjugal Rights under Section 9 of the Hindu Marriage Act, if you are a Hindu to get your Wife back to perform her marital duties. However, if she proves Domestic Violence as reason in Court of not coming back to you, then you will be prosecuted for inflicting Domestic Violence upon her
