I want custody of my daughter after the death of my wife

Well, if you want her Custody, you have to file a case either in the concerned High Court or in the Family Court. I advice you, to first file in the Family Court, then file in the concerned High Court, as it will then be as per the Hierarchy Policy of the High Court rules.

You can file application under Section 12 of Guardian Wards Act for the custody of daughter. where as u will. need to satisfy court that your have equal. right on your daughter. And her mother is with having knowledge of this thing forcefully keeping the child away from. you
