How to file for divorce under desertion since nine years

My father left us 9 years ago and hasn't returned since, mom wants to get a divorce. How should we proceed it?

go to courts and ask him to draft case under section 13(1) of Hindu Marriage Act or if there is no communication from him that file a suit for declaration to declare him not alive as after 7 years if you have no clue you can do the same

If you want divorce from your husband and he is not ready to give you divorce than you have to file divorce petition in court against your husband on the ground of desertion under section 13 of Hindu Marriage Act and court will grant u divorce. Two remedies are available to you, either you can file divorce petition if you are in knowledge of having the presence of her spouse that where he is residing. On the other side, if not known about his presence or livinghood the file suit for declaration about of his death.
