You can always file for divorce against your partner under cruelty grounds or any other legal grounds mentioned under section 13 HMA. I would suggest you to go for the mutual divorce because it is less money consuming and ends up in maximum of six months. For more legal assistance I am just a call away.

Husband and wife living separately for more than 15 years are very much eligible to file a divorce petition. Either of them may file a divorce petition, but it is a settled law that wherever the wife resides the case must be filed in that district family court only and the husband can not file this in his own district family court.

If your spouse agrees, both husband and wife can file divorce through mutual consent. however, if your spouse does not agree you will have to file for divorce. since both have been living seperately for 15 years you can file divorce on grounds of desertion. feel free to contact me incase of any queries.
