How to file divorce cruelty by husband

I an sikh woman. My husband is a drunk and has an affair. In the last 3 years twice he beated me cruelly with a 'leather belt'. And today he tried to beat me again but my 2 sons managed to save me. I cannot take this anymore i want a divorce. What can i have from him after the divorce to my childern successful in their life.

Madam, as your husband is treating you with cruelty, there are provisions in the Hindu marriage Act. for such cases and you can seek divorce from the court on these grounds of cruelty. there are also provisions for the divorce by consent of both the parties. In your case you have to move petition before the court and ask for justice and divorce. you have to mention the facts of beatings and other cruelties and you can expect divorce accordingly.

Yes, you can file divorce against your husband. Alongwith it you can claim maintenance from your husband for you and your children. Further, you can file complaint under s. 406,498 IPC and under domestic violence act as well. Under it, You can claim one residence and can also for injunction against alienation of properties by husband.

You can file a case of domestic violence as well as on the grounds of cruelty, if you have reported any incidence of beating to the police then it will help you in both the cases, your husband has to pay maintenance to you and to your children, you should have proof of his income, in DV case you can claim maintenance are well.

You can claim maintanance either in part , if you doesnt want to remarry or lumsum , and if there is matter about your sons they can claim share in the property if the same is ancestral otherwise it will depends on the sweet will of your husband ,.,.
