how to fight 125(3) crpc case in court

Is there any way to fight against 125(3) crpc when husband's salary is 60,000 and wife's salary is 85,000 and there is 4 years old child.
125 crpc won't be allowed if the wife is also getting a salary, 125 crpc only for maintenance, if defence accordingly, the application will be dissmissed
