How to expedite 498a case .........

18-Oct-2023 (In Divorce Law)
First date of 498a case was June 21st 2023. Nothing happened in that date. Second date was October 5th 2023. Nothing happened. No party appeared. What I got to know that, both lawyers have been informed. What does that mean ? If dates will be forwarded like this every time, how to bring the accuser to court ? What is maximum number of days one can ignore 498a case. How can I pressurize opposite party to come to court? What are the formal ways to regularly track and expedite the 498a case.

Usually what happens is once the accused appears after receiving summons from the court the accused is given opportunity of 2-3 dates. But, an accused cannot evade his personal appearance for further longer period. When an accused does not appear personally before the court after 2-3 dates then you can ask the court to issue warrant of arrest to bring him to the court and then the police will execute the warrant of arrest by arresting the accused and by forwarding him to the court concerned. Ask your lawyer to file a petition for issuance of warrant of arrest giving grounds for such arrest. Once the accused is arrested and is forwarded to the judicial custody, then your trial will be expedited. For further queries please contact.
