How to convince alimony and maintenance in mutual divorce to husband?

18-Feb-2023 (In Divorce Law)
This question is related to Seperation. My husband did not take me at his home. Husband wants mutual divorce on basis of incompatibility. I told him we can go for marriage counseling and give our marriage another chance. But my husband is adamant and wants to go for mutual peaceful divorce. I was a homemaker in our marriage. Indirectly he said to me I am a educated woman I can work. So it does not seem he is willing to give any maintainence and one full and final alimony. We are living apart for almost 18 months now. How to convince him and take alimony from him in mutual divorce ?

ok mutual divorce When you and your spouse have amicably resolved terms of separation to part ways, you can dissolve the marriage by filing a mutual consent divorce petition (under Section 13B of the Hindu Marriage Act, 1955) (under Section 28 of the Special Marriage Act, 1954) before the Family Court.

getting maintainence is another part and to get seperated by way of divorce is another. though you are a working lady and take divorce then also you can claim maintainence. For more details get my contact details from LawRato.

Dear queriest, as per your query you have mentioned that your husband is willing to go for mutual consent divorce and is trying avoid maintenance, in such case unless he agrees to give maintenance you don't go ahead with the procedure and question of conveniencing him in such case we have to file maintenance separately then. for more information about the same kindly contact me.
