How to change lawyer during second motion of divorce without NOC?

14-Aug-2023 (In Divorce Law)
Can I change lawyer easily during the second motion of mutual consent divorce without taking NOC from my current lawyer? My current lawyer is asking me to pay him 3 lakhs before the second motion then only he'll appear for the second motion. He's literally looting me, he won't give me noc. I have paid him 80 thousand rupees, 50 thousand through transfer in the bank account, and 30 thousand cash. Can I present this info before the judge and can get noc easily? Please help.

you do not need to obtain any NOC from the previous lawyer.
you can simply engage another lawyer for the hearing and ask the previous lawyer that you have appointed someone else to look into the case.
you can sign a vakalatnama in favour of the new lawyer and from thereon the new lawyer cam represent you.

Changing of advocate is not a challenge. You may appoint a new advocate for your further proceeding if the respective court allows in between the current case.
You may follow the steps as your convenience .
1. Ask the court if you can change.
2. Find a new lawyer.
3. Terminate the representation with your initial lawyer.
4. File a motion for substitution of attorney.
5. File for a continuance, if necessary.
6. Request your file from your former lawyer.
7. Request return of unearned fees.

You do not need NOC from a lawyer to file 2nd Motion also it’s against law to hold the file of the case
2nd motion is a fresh case and you can file with a different lawyer you can discuss it with me for further information

please reach out to any lawyer. there's no law as to same lawyer for both the proceedings. don't get harassed and fooled by such advocates. it's not right. you don't need to pursue case with that single lawyer.
