How to cancel petition of divorce when dont want to proceed with it

I have filed a case against my husband in a family court for divorce now I don't want divorce .What should I do now . Half of the payment has been done to lawyer . they return it or not tell me this also ?

You have to get the case withdrawn by making application of withdrawal to the family court. Your advocate will do that for you. About the fees paid to the advocate for filing the case, you should not ask for return of it as your advocate has worked on your case. Preparing a draft of Divorce petition and other formalities of filing the case mean your advocate has done almost half of the work .

Yes you can withdraw Divorce petition anytime during the proceedings. You just need to file a withdraw application before the family court citing reasons that you have settled the problem amicably and will cohabit.

ur filed an application before the court.
I.e.
APPLICATION FOR WITHDRAWAL OF PETITION.
the petitioner begs to submit as under
1. that, the instant matter filed by petitioner for restitution of conjugal right before this Hon'ble court.
2. that, the petitioner does not wants to proceed the matter, for some unavoidable reason, therefore the petitioner wants to withdrawal of the present petition.
prayer:- it is therefore humbly, prayed that, this Hon'ble court be pleased to withdraw the present petition for restitution of conjugal rights in the interest of Justice.

You can simply withdraw your petition on the ground that you don't want to proceed with petition anymore, for that you have to physically present in the court as well as submit one applicant before the Hon'ble Court.

This is my response to you:
1. Withdraw the petition;
2. The lawyer will refund you as per his wishes;
3. He may return just part of it;
4. Lot of efforts go into the drafting, researching and filing of the petition;
5. Therefore be sure whether you want to withdraw the same.
