Hi I have been married for almost 5 years now to a UK citizen. I have a 8 month old daughter. i have been through domestic violence also. my husband is born uk citizen and his entire family is also there. they have not even come to see my daughter. he went to uk last may and has not come since then. he doesn't work n has never worked a fact we were not told.i don't have any financial help neither from him or his family. they are not doing anything to take me or my daughter to UK. i am staying with my parents and struggling everyday as a single parent. I now want to leave him and give my daughter to him as the kind of life i want to give her i cant afford dat. she is entitled to UK citizenship by birth. she will at least get good education and medical care there as its free. they just prolonging to come bac. what shud i do? can i lodge a complaint with UK govt so that he comes bac ?

In this case you have to use symbolic methods to bring your groom back. The first thing you do is to file a complaint with the NRI cell of your concerned area with all details and evidences you have with you like marriage certificate, birth certificate of your child, pics of marriage, witnesses and thereafter send a copy to Mrs. Sushma Swaraj and approach a reporter of good news channel and president of all India Female Welfare Association. Mrs. Sushma Swaraj is very helpful and aggressive in this type of matters to deal with outstation Indians. Thereafter an application shall be filed in the court of U.K to assess the assets of in laws and fixation of maintenance.

it will be better that you may start proceedings before UK court. in India it will be difficult to summon and it will take long time. you can definitely leave your daughter with him as per law of that country and he is bound to take care of her daughter. it is better advised to file litigation there in UK

filling a complaint in India will be good for you as the legal action here will be through the embassy and court. the matter requires further details for e.g place of marriage , mode of solemnisation etc. since these details will be required for giving a better opinion to you.
