How safely can we use section 61 BNS

How safely can Implead any person under section 61. My wife gave joint property to rent without my consent by saying to tenant that my husband is not india and he is in USA. And she is talking to a third person without knowing to me from more than a year. I have provision to file cheating case on her now with these grounds? How safely I can implead the third person in to it as conspiracy. Please advice!

Merely because your wife was communicating with a third person or leased the property without your consent does not, by itself, establish cheating or criminal conspiracy. A third person should be impleaded only where there is credible evidence of active participation, dishonest intention, or conspiracy. If the tenancy or any transaction involving the joint property was carried out without lawful authority, you may pursue appropriate civil remedies and, where the facts disclose cognizable offences, appropriate criminal proceedings. Proceed strictly on the basis of documentary evidence to avoid unnecessary complications.

your first question you and your wife having joint property, without your consent she has given the joint property for rent to tenants,By saying that,my husband is in USA,you have a right to claim of rents in that joint property,By equal share,Are you staying with your wife,tell me,I will let you know for solution,By giving legal Advice,Second question is your wife is talking with a third person,from more than a year,if your having any proof of evidence,when she is talking with a third person,we can file a Divorce petition,on the grounds.
