How much time it take to get court date after filing mutual divorce pe

09-Oct-2023 (In Divorce Law)
The lawyer hired by my husband for mutual. We don't have any cases. Now 2 month has completed since I signed the paper. Now the lawyer is saying I filed the petition to court it will take another 1 month to get a date from court. Out divorce is simple. We have no cases no alimony no disputes in settlement. Did it take one month to get a court date after filing petition?

First of all it is advisable to engage your separate lawyer for mutual consent divorce. Now since you have not engaged Any you are at their mercy for the information. After filing it should not take 1 month. Do engage a lawyer and go by his advise.

Greetings to you.
There are Judgements of the Supreme Court according to which you can get mutual consent divorce without much delay.
Ordinarily court does take a lot of time but it’s entirely up to your advocate to make sure that it’s expeditiously done as per judgement of the Supreme Court.

If you require any assistance, please feel free to reach out.

Thanks

If you both are settling your disputes through the settlement deed and applying for mutual divorce then the whole process will take a maximum period of six months. Nowadays the time frame of six months can also be reduced by moving a preponement application before the court. And it doesn't take 3 months for the first date of hearing.

If you doubt your husband’s advocate it is better your hire your own advocate to speed up the process. Filing of case happens in a day or two.
Kindly b in touch if u look forward for legal assistance

No, the case is usually listed immediately in court after filing divorce petition.
you can hire a lawyer to represent you in the case and give a fair idea of the case proceedings.

Hi thank you for the response. It is a simple divorce so we don't think that much to have separate lawyer. Can you please tell me maximum time it will take after filing petition to get court date

There is no fixed answer for this and it entirely depends upon what time the filing of the petition was made, and moreover, the availability of the judge, the load on the court regarding fresh matters, jurisdiction, etc.
