How long do divorce cases go for, wife filed false cases against me

12-Mar-2023 (In Divorce Law)
I got married 1 year 3 months ago. After marriage my wife resided only for 3 to 4 days at the matrimonial home. She also took with her the anscestral Gold Ornaments which cost 1 lakh without informing us. We have receipt of purchase for the same with us.After that she started avoiding me and never answered my calls and messages. she got placed with the IT MNC with good package and earning 20000 plus per month. I filed Divorce case under section 13 (1) (ia) of Hindu marriage act 1955 and case status shows Notice Unready. Two dates have already gone and next date is in April. She has also filed following false cases on me under section 9 and maintenance case under sec 125 along with Domestic Voilance case. she is demanding 22000 from me. I am the only earning person in my family and I have to take care of three senior citizens. Question - When I will get divorce? What will be the expected time to get divorce in my case? Question – How to fight against false case

Everything will place on its place once we prove that she is earning very well and also she we can demand maintenance from her if she is earning more than you, as she has left the matrimonial home without any reason. The question of getting divorce totally depends on the court as well as on the parties. It can take 1 year 2 years or more than that. For more advice kindly call on my number

At the outset there is not time limit for any litigation it means within specific time it should come to an end. No one will and no one should give guarantee of prescribed time for any case/litigation which will come to an end in specific time since there are many factors involved in it i.e. to say co-operation of lawyers of both parties, availability of witnesses and judicial workload of Ld. Judge to whom the concerned matter is assigned with etc. In matrimonial matters generally Court proceeds very cautiously since it involves many personal and delicate issues in the life of both parties.
Now as far as alimony is concerned it is depend upon various circumstances of both the parties like standard of living of husband and wife, the education of both parties, the expenses and liabilities of both the parties (particularly the husband since he is the one who has to pay the alimony), the responsibility of husband to maintain his parents not being extended family. It is the settle principle of Law that whatever be the case husband has to maintain wife reasonably and sufficiently. It can also be said that standard of living of wife shall be commensurate to that of husband. Obviously the Court will consider everything depending upon the documentary and oral evidence led by both the parties. It is all depend upon facts and circumstances of each case as there is no straight jacket formula for grant of maintenance.
Now as far as false cases as pleaded by you is concerned you can appear in concerned Court through Lawyer or as party in person and defend yourself by leading evidence in accordance with Law.
Lastly as far as ornaments which your wife took away with her is concerned and if those are not Streedhan you can lodge police complaint under Indian Penal Code of issue legal notice prior to it to avoid bitterness.
