How do I proceed with a divorce for this?

08-Jan-2024 (In Divorce Law)
My husband has been physically, verbally and financially abusing me for the last 5 years of our marriage. He hasn’t worked over the past 5 years and I have been bearing the burden. I want to file for a divorce, but I don’t have proof of the physical abuse. What do I do? Also I’m scared I might be harmed emotionally by his family when they get to know of my decision, how do I protect myself?

First you talk to your husband about your issues that you want separation because of his harassment and then also his behaviour is not improving then lodge a complaint before women police station. If matter settles over there then ok otherwise you can file divorce and maintenance on mental cruelty grounds there is no requirement for physical Harassment evidence and you can seek police protection through Domestic Violence application so no question of being scare of him.

it you can show that he has not worked for last some years and give evidence on financial abuse rest allegations can be made. Your fear of Emotional harm from his family members is not clear to me. You can seek whatever protection you need from Court.
