have questions regarding section 125 cr pcMy wife filed section 125 cr pc maintenance case on me. My wife is in india and I am in Saudi arabia countryLawyer sent me a whatsapp with pdf documents stating that he has filed petition against me and in that petition he has given my saudi company address. nnAfter that I closed that whatsapp number. I checked online the status of my case and it is showing that summons has been issued on my name. But I did not receive any summon at my office address or home address in Saudi ArabiaMy questions:n_______________nn1. The summon as per online status is issued on 04-07-2022, how long does it take to reach the summon in a foreign county? And what if I refuse to accpet it? HownnShould I also appoint a lawyer immediately or wait till summon is issued? nn3. If I never receive the summon, will the court will dismiss my case?nn4. What if I don't come to India for 5 years, even if exparte order is passed, can I open the case again after my return
in your case summons is issued . if you receive someone on WhatsApp it will consider as you have received the summons , court will see to Blue ticks on WhatsApp and if you do not come court will pass ex Parte order . if summons send through post to your office address and if you refuse it will consider as summons is duly served . if Court pass ex Parte order your appeal period shall be 30 days any issue come after 5 years court will not condone you are delay o r may Condon your delay with heavy cost

The summons can be served on you through Indian embassy in Saudi Arabia and if you do not appear, exparte order for maintenance will be passed against you. And to recover the maintenance amount, distress warrant and subsequently attachment of your movable and thereafter immovable property may be done on court order till the recovery of maintenance amount.

Even if u do not come she can proceed exparte against u and she will get maintenance and once she got the maintenance u can't do anything. Even if u refuse to take summon, it is considered as service upon u. Appoint a lawyer immediately and fight against her.
