How claim of abuse is validated

Hindu. Housewife has submitted to the court claiming that the working disabled husband is abusing her. What are the ways the court will proceed with validating if the claim is geniune or not.
The court does not decide such allegations solely based on the wife's statement. The burden is on the person making the allegation to establish it through evidence. The court will examine pleadings, oral testimony, cross-examination, medical records (if any), police complaints, witness statements, electronic evidence such as messages, call recordings, CCTV footage, and any other relevant documents. If the husband is a person with disability, the court will also consider his medical condition and its relevance to the allegations, but disability alone neither proves nor disproves abuse. The court evaluates the entire evidence on record before arriving at its conclusion. It is advisable to engage a family law advocate to present the case effectively.

The wife must prove her claims through credible evidence such as medical records, police complaints, witness testimony, electronic communications, photographs, audio or video recordings, or any other relevant material. The husband will have a full opportunity to file his reply, produce his own evidence, and cross examine the witnesses. In matrimonial disputes, the Court may also refer the parties to mediation or counselling, wherever appropriate. After considering the entire evidence from both sides, the Court determines whether the allegations of abuse are substantiated. The husband’s disability, by itself, neither proves nor disproves the allegations.
