Home Loan can be Considered As Liability?

I have a home loan and need to pay EMI 30,000 per month. Can court consider it as liability for me and adjust accordingly for maintenance to wife?
yes it can be considered by showing specific grounds so the the loan you have as a burden which needs to be paid EMI 30,000 per month by you so the maintenance must be adjusted as per the accordingly..

there are two aspect to it. first maintenance is about enabling the hapless wife to continue her living with dignity as per the socio economic standard of her estranged husband. if after fulfilling all your liabilities the court finds you have means to grant maintenance toyour wife then it wont bother the court much. if the court sees your liability as your luxury it might boomerang. home loan if taken after you and your wife became estranged then certainly it would be counted as luxury.
