actually mother and the father are the natural guardians until the child's majority age this both persons can legally claim the guardianship of the child you had said your child is 15 years old as per law he is a minor in case you had died in the minor age of the child then definitely the custody will go to the father there is no doubt in it if you are condition is like that it is the law . when you are husband is not in the position to maintain the child due to is mental illness or due to she is addictions like alcoholic or drugs or he leaves and immoral life or yes no capable to maintain a child then these are the relevant factors a considered by the honorable court to avoid the guardianship of the father in the time the grandparents can claim according to the health education and living condition and the betterment of the child the custody may be wested on the grandparents in rare of the rarest circumstances
