You may file petition on behalf of the child to claim educational expenses subject to the alimony which he paid you at the time of mutual consent divorce . the consent terms of the said divorce if say otherwise about child expenses and custody then it may estop you from asking child's expenses.

At the time of mutual divorce, there is a clause for consent terms wherein husband and wife mutually agree for issues related to marriage such as maintenance, child custody, division of property, stridhan, etc. Accordingly, a decree for divorce is passed by the Court. However, if you wish to claim maintenance for your child, you can make an application for the same even after your mutual divorce.
