Harassment and Invasion of Privacy by ex-husband

04-Jul-2025 (In Divorce Law)
My ex-husband, despite a settled custody agreement, is harassing me post-divorce. He sends abusive emails and messages to me, my husband, and in-laws, spreading false allegations and pressuring me to give up custody of my daughter. This is affecting my mental peace and family life. Can I get a restraining order and modify the custody terms based on this ongoing harassment?

Yes, you can get a Restraining Order from Court to restrain him from harassing you mentally and abusing you! If he doesn't stop, he can be booked for Contempt of Court once the order gets passed in your favor by the concerned High Court.

You can approach the police station and file complaint against your ex husband and your in laws for harassment. Also you can file complaint for pressurizing you to handover the custody of daughter to him. The same is against the terms and conditions agreed between you and your husband for divorce. If the divorce is by mutual consent and he has consented for giving the custody to you the same cannot be challenged by him. You can approach the family court for harassment by your husband.

Yes, you can get the terms of custody modify by making an application to the Court. Custody of children is never final and can be modified based on change in circumstances. Feel free to contact me for seeking any legal advice as regards the same.
