Guidance for Consideration of Joint Family Income in a PWDVA case

21-Aug-2023 (In Divorce Law)
I seek guidance on a divorce case involving my sister, Shital, and her husband, Sanjay, Sanjay is not engaged in any external job; he handles the family's business, including the management of their school, college, and farming. On what grounds how can I prove or suggest to court that parents income and properties should be considered in Sanjay's income sources in our PWDVA case, Sanjay and his family are joint family. The concept of a Hindu Undivided Family (HUF) might also be applicable.

I have gone through your query. The Husband of Women is liable to pay her and her children Maintenance. That it is his responsibility to earn in every possible way to provide for his wife and children. The SC have given some guidelines while deciding such Applications from the wife.

No, you cannot get an award of Ancestral Moveable and Immovable Properties while claiming such as part of Maintenance from Husband before Court, considering, a wife can claim Self made assets of his mere Husband, not of his family.
